In fact, that's not a #darkpattern. That is straight non compliance.
This is so because the notice is not part of the page (therefore, not “published”). It only comes in in response to an explicit (and as pointed out, uncommon) user action: top scrolling. And that only assuming that one allows static.s-sfr.fr to run the banner-on-scroll-top.js script.
If anyone wants to give #DDPP Paris a heads-up I'm sure they'll be pleased to know. 🙂

To be clear: this is akin to making the information available on a number that you have to call… provided that you guess the number first.
That is contrary to the definition of « publier » in the intended sense of « rendre (quelque chose) publique et notoire, manifeste »
